Agreement and eligibility
These terms form an agreement between Evarin Pty Ltd (ABN 98 697 805 146), trading as Candora, and the organisation or person using the Candora service. By creating an account, purchasing a membership, administering an organisation, or submitting a survey response, you agree to the parts of these terms that apply to you.
Organisation accounts are for business use. The person creating or administering an organisation confirms that they are authorised to act for it and are at least 18 years old. Survey participants may use Candora only through a valid invitation or public survey link.
Accounts and organisations
You must provide accurate account and organisation information, keep credentials secure, and promptly tell us about suspected unauthorised access. The first verified paying account holder is ordinarily made the owner of the organisation it provisions.
Organisation owners control administrator access and are responsible for actions taken through their accounts. Participant email addresses may be business or personal addresses where the organisation lawfully uses them for the survey.
The Candora service
Candora helps organisations create, deliver, and report on employee surveys. Features may include survey templates and drafting, participant and reporting-group management, private invitations, reminders, privacy-safe statistical reports, thematic findings, and exports.
We may improve or change the service over time. We will not materially reduce a paid core service during a current billing period without reasonable notice, except where a change is necessary for security, law, or the protection of participants.
Anonymous reporting boundary
Candora is designed so survey answers are completely anonymous to the employer. The employer cannot switch anonymity off, access participant-linked answers or individual comments, or recut reports to reconstruct a person's response.
Candora processes identity and response linkage in a restricted source layer so it can send invitations, prevent duplicate responses, calculate participation, and create reporting groups. Employer-facing results come from a separate privacy-safe layer and small groups are suppressed. This boundary is described in our privacy explainer and Privacy Policy.
Customer responsibilities
The customer must:
- have a lawful basis to provide participant contact and reporting group information and to run each survey;
- give employees any notices, consultation, consent, or workplace information required by law, policy, contract, or industrial arrangement;
- use appropriate questions and avoid requesting unnecessary personal or sensitive information;
- not attempt to identify respondents, combine Candora results with other information to infer answers, or pressure participants to reveal what they submitted; and
- use reports fairly and not as the sole basis for adverse employment decisions about an identifiable person.
The customer owns its survey content and data, subject to the rights Candora needs to operate the service and protect participants.
Participant use
Participation should be voluntary unless the inviting organisation clearly states a lawful requirement otherwise. A private invitation is intended only for its recipient and must not be shared. You must not submit unlawful, threatening, deliberately false, or malicious content, impersonate another person, or try to interfere with the service.
Avoid identifying yourself or another person in written responses unless it is necessary and appropriate. Candora may remove or withhold content where reasonably necessary for safety, law, or privacy.
Membership, quantities, and billing
Candora membership is priced in US dollars at USD $1 per participant place per month, with a 50-place minimum (USD $50 per month), unless a separate written order says otherwise. Membership includes unlimited surveys. The purchased quantity limits how many people can be included in each survey, not the total size of the organisation's roster.
Quantity changes are prorated. A participant included in a scheduled, live, or paused survey cannot be replaced in that survey by changing the roster. Prices and applicable taxes are confirmed at checkout.
Checkout, payment, invoices, and payment methods are handled through Stripe-hosted services. Where Stripe or a related entity acts as the merchant of record, its checkout terms also apply to the transaction. Candora does not receive complete payment-card details.
Renewal and cancellation
Membership renews automatically each billing period until cancelled. An organisation owner can manage payment details, quantities, invoices, and cancellation through the billing portal.
Cancellation stops future renewal. If a first membership is cancelled within 14 days, Candora access may end immediately. Otherwise access ordinarily continues until the end of the current paid period. If the first membership is cancelled within 30 days and no survey has been launched, we will refund the initial membership payment. Other cancellations do not automatically provide a refund, except where required by law or expressly agreed in writing.
Acceptable use and suspension
You must not break the law, infringe another person's rights, probe or bypass security or privacy controls, introduce malicious code, overload the service, resell access without agreement, or use Candora to facilitate discrimination, retaliation, harassment, or surveillance.
We may restrict or suspend access for non-payment, material breach, security risk, unlawful use, or a threat to participant privacy. Where reasonably possible, we will explain the issue and allow time to fix it. We may act immediately where delay would create material harm.
AI assistance and use of reports
Some Candora features use AI to prepare survey questions, structure roster proposals, and create thematic findings. Automated output may be incomplete, inaccurate, or unsuitable for a particular workplace. Customers remain responsible for reviewing survey content and reports and for decisions made using them.
Candora reports are decision-support material, not legal, medical, psychological, industrial-relations, or professional HR advice. They should not be used as the sole basis for decisions affecting a person.
Intellectual property and feedback
Candora and its licensors own the service, software, product design, templates, and related intellectual property. During an active membership, we grant the customer a limited, non-exclusive, non-transferable right to use the service for its internal business purposes.
If you provide product feedback, you allow us to use it without restriction or payment, provided we do not identify you publicly without permission.
Confidentiality and privacy
Each party must protect the other's confidential information and use it only for the service or as required by law. Candora's handling of personal information is described in the Privacy Policy.
These terms do not give a customer access to restricted raw survey responses. Participant privacy controls continue to apply after a membership ends.
Warranties and liability
We provide Candora with due care and skill but do not promise that it will always be uninterrupted, error-free, or meet every customer's particular purpose. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.
To the extent permitted by law, neither party is liable for indirect or consequential loss, lost profit, or lost opportunity. Each party's aggregate liability arising from the service is limited to the fees paid or payable for Candora during the 12 months before the event giving rise to the claim. This cap does not apply to fraud, wilful misconduct, breach of confidentiality or privacy obligations, infringement of intellectual property rights, or liability that cannot legally be limited.
Ending the agreement
Either party may end the agreement for a material breach that is not fixed within a reasonable period after notice, or immediately for insolvency or a serious security, legal, or privacy breach. On expiry or termination, access ends subject to any paid-through period and lawful retention. Provisions that should continue by their nature, including confidentiality, privacy, ownership, payment, and liability terms, survive.
General terms and contact
We may update these terms to reflect service or legal changes. We will give reasonable notice of material changes affecting an active paid membership. Continued use after the effective date constitutes acceptance; if a material change is unacceptable, the customer may cancel before it takes effect.
These terms are governed by the laws of New South Wales, Australia. Before starting court proceedings, each party will try in good faith to resolve a dispute by contacting the other. The courts of New South Wales have non-exclusive jurisdiction.
